79 Appendix G FERPA Policies NSU University School FERPA Policy Information contained in cumulative records and in the contact information in My Back Pack is confidential as is personal information volunteered to you by either a child or his/her parent. It is expected that the integrity of the confidentiality of such information will remain intact. Cumulative records should not leave the office area. Resource and psychological records are held even more confidential than the cumulative record. Under no circumstances should a child’s education status, services, disciplinary records or disabilities be discussed except in a professional capacity. Discussion of students with other teachers should serve only to benefit the student and not as a venting session. It is best if individual circumstances are discussed as hypothetical when at all possible. Family Educational Rights and Privacy Act (FERPA) The Family Educational Rights and Privacy Act of 1974 (FERPA), also known as the Buckley Amendment, affords students who are at least 18 years old (“eligible students”) and the parent(s) of students under 18 years old certain rights with respect to the students’ education records. These rights include:  The right to inspect and review the student’s education records within 45 days of the day NSU University School receives a request for access. An eligible student or minor student’s parent(s) should submit to the division director a written request that identifies the record(s) the student or the student’s parent(s) wish to inspect. The Registrar will arrange for access and notify the eligible student or minor student’s parent(s) of the time and place where the records may be inspected.  The right to request the amendment of the student’s education record that the eligible student or minor student's parent(s) believe is inaccurate or misleading. An eligible student or minor student’s parent(s) who believe that the student’s education records contain information that is inaccurate or misleading, or is otherwise in violation of the student’s privacy, may discuss such concerns informally with the division director. If the decision is in agreement with the request for amendment, the appropriate records will be amended. If not, the eligible student or minor student’s parent(s) will be notified within a reasonable period of time that the records will not be amended and will be informed by the NSU University School Registrar of the right to a formal hearing.  The right to consent to disclosures of personally identifiable information contained in the student’s education records, except to the extent that FERPA authorizes disclosure without consent.  The right to file a complaint with the Family Policy Compliance Office, U.S. Department
