69 Any student found in violation of the drug-free schools and campuses policy with regard to the unlawful manufacture, distribution, dispensation, possession, or use of illicit drugs or alcohol will face serious university disciplinary action, which may include expulsion from the university (see Controlled Substances Chart in Appendix A.) Drugs and Alcohol NSU University School is committed to the mental and physical welfare of each student. Alcohol and drug use are detrimental to the student’s welfare and detract from the educational environment of this institution. As a result, the school has a zero-tolerance policy for drug or alcohol use among its students. The school believes that all students have the right to attend a drug-and-alcohol-free school. Under this policy, prohibited activities are possession, sale or attempted sale, use and distribution, or attempted distribution of illegal or prescription drugs without a prescription or over the counter drugs and/or alcohol. Factors that may cause the school to suspect a violation of this policy are based upon the student’s conduct, physical appearance, unexplained or unusual behavior, other signs of involvement with drug use, or receipt of the information from third parties regardless of the amount of alcohol/controlled substance. The school will employ any reasonable method to ensure that the zero-tolerance drug/alcohol policy is not violated. To the end, the school reserves the right to conduct random searches as well as probable cause searches by authorized school personnel, trained canines or authorized third parties. This right to search will extend to any item brought onto school property or to school-sponsored activity. Searches may include but are not limited to: lockers, book bags, purses, vehicles, clothing, electronic data stored on cell phones or other devices, and other personal property. In the event of any suspected violation, an administrator will conduct an investigation to determine the extent of a student’s involvement in any prohibited activity. These findings will be presented to the Executive Committee for disciplinary action. The Executive Committee considers all cases in which infractions may result in a student’s separation from the school. Notes Regarding Recommendations for Suspension and Expulsion: Recommendations for expulsion do not automatically result in expulsion. School administrators have the authority and flexibility to consider other disciplinary action based on the offense, age of student, previous disciplinary record, extenuating circumstances, and totality of the incident. However, chronic misbehavior that results in progressive sanctions at one level may result in expulsion. WEAPONS POLICY – ZERO TOLERANCE Weapons are prohibited on campus. A weapon includes any item designed to inflict a wound or cause injury to another person any item used to harass, threaten, intimidate, assault, or commit battery any item the university deems dangerous Firearms and ammunition are strictly prohibited from the campus under all circumstances.
