38 Nova Southeastern University Student Handbook b. the mouth of a person by a sex organ of another person, without that person’s consent 5. acquaintance rape, which is defined as forced, manipulated, or coerced sexual intercourse by a friend or acquaintance C.6 Sexual Violence is physical acts of a sexual nature perpetrated against a person’s will or where a person is incapable of giving consent. This includes violent behaviors that may also constitute rape, sexual assault, sexual abuse, and sexual coercion. C.7 Sexual Exploitation is behavior where one person takes sexual advantage of another person for the benefit of anyone other than that person, without that person’s consent. Examples include prostituting another person; photographing or recording another person’s sexual activity, intimate body parts, or nakedness without consent; distributing sexual images of someone without consent; and viewing a person’s intimate body parts without consent when someone has a reasonable expectation to privacy. C.8 Sexual Harassment is unwelcome conduct of a sexual nature, such as unwelcome sexual advances, unwelcome verbal sexual comments, and other forms of sexual misconduct. C.9 Stalking is engaging in a course of conduct directed at a specific person that would cause a reasonable person to fear for safety or suffer substantial emotional distress. University Disciplinary Procedures D.1 Introduction A student (or student organization) who is alleged to have violated policies of the NSU Code of Student Conduct and Academic Responsibility and/or any other university policies and procedures (other than the University Sexual Misconduct Policy) may be charged under the NSU Student Disciplinary process. A complaint may be made by any member of the university and/or nonuniversity community. The process through which students (or the student organization) are held accountable to university policies and procedures is intended to promote a better understanding of the university community and acceptable behavior for students who are a part of that community. With that in mind, it should be noted that the following processes occur only between the university and each individual student involved in an investigation into possible violations. Parents, friends, significant others, and or attorneys are not permitted to participate in, or observe, the disciplinary process. Upon notification that a violation may have occurred, the assistant dean for student development and/ or designee will investigate the circumstances of the case using the following process. The following figure illustrates the University Disciplinary Process for Individual Students (not used for University Sexual Misconduct Cases—please refer to Section D.4).
